PRICES AND PAYMENT
Prices on brochures and advertising are subject to change without
notice. A 50% deposit is required at the time of placing your
order. Payment can be made by cashier's check, certified check,
money order, or credit card. Balance will be paid in full prior
to the shipment of your order and after clients signed acceptance
of audio and print proofs. The customer agrees to pay all costs
and expenses including legal fees incurred by Music Masters in
connection with the collection of amounts owing to Music Masters.
TURN-TIME
Day of receipt of all source material and/or day of final artwork
or audio master approval is starting day zero.
CUSTOMER'S LIABILITY FOR
INFRINGEMENTS
The customer shall indemnify and save Music Masters harmless
of and from all suits, claims, demands, and other liabilities
and expenses, including legal fees and disbursements arising
out of the production, distribution or exhibition of any films,
tapes, or phonograph records or equivalent in connection with
which Music Masters shall have furnished any goods and services.
The client must supply us with the appropriate forms and materials
proving the ownership of the material being replicated or duplicated
by Music Masters.
CUSTOMER'S MATERIALS
Materials stored on the premises are done so at the customers
own risk. Materials left 12 months after completion of the last
order become sole property of Music Masters. CD duplicates sold
by Music Masters to the customer, from customers own prepared
CD masters, will not be guaranteed. These CD duplication masters
will be the sole responsibility of the customer. Faulty discs
can be produced if the original master is improperly mastered.
CD masters prepared by Music Masters for CD replication are authorized
by the customer for the production of compact discs, these replicated
discs are fully guaranteed.
LIMITATION OF LIABILITY
AND WARRANTY
Music Masters warrants that it will take every precaution for
the safety of clients' audio masters, artwork, photos, etc.,
in production or storage, however Music Masters assumes no risks
and makes no guarantees unless such loss or damage is caused
by the willful negligence of Music Masters or any of its employees
acting within the scope of their authority. All audio masters,
artwork, photos, etc., supplied by the client remain the sole
property of the client. Music Masters denies liability for any
incurred damage due to any casualty.
SEVERABILITY
Each term of the Terms, Conditions & Policies is severable
from every other and shall survive the nullity or unenforceability
of the other.
MODIFICATION
These terms and conditions can only be modified by an instrument
in writing signed by an authorized representative of Music Masters.
ENTIRE AGREEMENT
These Terms, Conditions & Policies and the written instrument
signed by the customer constitute the entire agreement between
the customer and Music Masters, and no evidence of any oral agreement
or representation whatsoever be admitted to vary, modify, waive,
or add to any or all terms of this agreement.
